Minister of the Supreme Electoral Tribunal, Raúl Araujo, who monitored the Lollapalooza Festival at the request of PL, President Jair Bolsonaro’s party canceled his order Monday night (28). He welcomed the filming in which the commentary abandoned the work.
PL decided to back off after Bolsonaro, troubled by the ill repercussions of the casewas furious and ordered the head of the party, Valdemar Costa Neto, to return and withdraw the Supreme Electoral Tribunal’s procedure.
In his decision, Araujo was right Withdrawal request It repeals the injunction banning political demonstrations and stipulating a R$50,000 fine if artists take a stand against any candidate or political party during concerts.
The minister also blamed the president’s party for the censorship attempt.
According to him, his decision to fine the event for the anti-Bolsonaro demonstrations was made “based on the understanding that the organization of the event promoted ostensible political propaganda encouraging artists” to express themselves politically – which was not true.
Araujo had come to this conclusion because the “representative,” i.e. the PL, implied in his request for censorship that the organization of Lollapalooza “supposedly was encouraging outward and outward electoral propaganda at the aforementioned event.”
In his letter, the minister emphasized that “artists, individually,” “are guaranteed by the federal constitution broad freedom of expression.”
By decision of the judge, the case is closed permanently.
The controversy started after Araujo issued a decision last Saturday (26) confirming the ban on demonstrations for or against any candidate or political party at the Lollapalooza Festival, under pain of a fine.
The suit was filed by PL after singer Pabllo Vittar gestured with her thumb and forefinger, forming the letter L, in support of former President Lula (PT). Later, They were shown in the midst of the audience with a flag in the face of the Labor Party.
The day after the decision, The artists ignored the decision and shouted criticism at Bolsonaro And praise to Lola.
In the resolution, Araujo stated that Pablo presented “clear electoral propaganda in favor of a potential candidate for the position of President of the Republic, at the expense of another potential candidate, in blatant disagreement with the provisions of the electoral legislation, which at that time prohibited propaganda of a partisan political nature”.
In his order, he said, “I partly reject the request for fairness that is phrased in the representation order, meaning respect for the legal prohibition, and the prohibition of investigating or showing ostensible and overdue electoral propaganda in favor of any candidate.”
