The House of Representatives Committee for the Defense of the Rights of Persons with Disabilities approved a draft law ensuring the distribution of disposable diapers, within the framework of the Unified Health System (SUS), to the elderly, persons with disabilities and other patients who have lost control of their physiological functions.
Under the proposal, diapers would be classified as products of health concern, along with orthotics, prosthetics, collection bags and medical equipment.
The approved text is substitute By Representative Marcio Honezer (PDT-MA) to Bill 2678/23, by Representative Paolo Letro (PSD-PR). The rapporteur chose to include in the text the measures provided for in the projects that were attached (PL 3086/23, PL 3188/23, PL 3603/23, PL 4473/23). As a result, it was decided that the amount of diapers allocated to each beneficiary would be determined according to individual needs, taking into account factors such as age, among others.
According to Hanisar, ensuring the right to supply diapers under the law will enhance this practice. “When a health issue becomes the subject of law, it becomes a sustainable and effective state policy, rather than a temporary government policy,” he said.
