According to the article, a source familiar with the open investigations said that the ongoing investigations already allow us to say that there is “extensive evidentiary material” to incriminate the former directors of the company.
Furthermore, board members are “not exempt from liability” and must reach penalties.
It is worth noting that the Americanas Board of Directors includes representatives of the main shareholders, namely the investor trio Jorge Paulo Lehmann, Carlos Alberto Secupira, and Marcel Telles. Secupira himself is part of the council, as is Paulo Alberto Lehmann, Jorge Paulo’s son.

The former CEO says Secupira and Lehman’s son knew about the $1 billion vulnerability in Americana
Last week, former Americanas CEO Miguel Gutierrez, who was in charge of the company when the fraud occurred, said Carlos Alberto Secupira and Paulo Alberto Lemann were aware of the vulnerability in the retailer’s accounts.
This accusation came in documents submitted to the parliamentary investigation committee that was investigating the case.
Upon admitting the fraud, in June, Americanas held Gutierrez and three other directors responsible and absolved the directors and shareholders of reference from any involvement in what happened.
But the former CEO denied the accusations against him before the CPI and claimed that Sicupira was closely monitoring the day-to-day activities of the company. Americanas refuted Gutierrez’s statement.
