However, the employee is still entitled to a 40% termination penalty on the deposits made by the company.
All contract workers who have a balance in FGTS can choose the birthday withdrawal method. This choice is not automatic and requires the individual to register by the last day of his/her month of birth. If the worker does not express interest, he/she will not be able to make the withdrawal in this way.

How do values and deadlines work?
The amount that can be withdrawn annually from the Social Security Fund varies according to the total balance in the worker’s account. There are balance ranges that specify specific withdrawal percentages, which ensures that the worker can withdraw part of the accumulated balance annually, according to the rules set by the government.
- Balance up to R$500.00: Withdraw 50% of the balance.
- Balance between R$500.01 and R$1,000.00: Withdraw 40% of the balance plus an additional installment of R$50.00.
- Balance between R$1,000.01 and R$5,000.00: Withdraw 30% of the balance plus an additional installment of R$150.00.
- Balance between R$5,000.01 and R$10,000.00: Withdraw 20% of the balance plus an additional installment of R$650.00.
- Balance between R$10,000.01 and R$15,000.00: Withdraw 15% of the balance plus an additional installment of R$1,150.00.
- Balance between R$15,000.01 and R$20,000.00: Withdraw 10% of the balance plus an additional installment of R$1,900.00.
- Balance over R$20,000.01: Withdrawal of 5% of the balance plus an additional installment of R$2,900.00.
