Caixa Econômica Federal has to distribute, until the end of August this year, the billionaire’s earnings from the FGTS (Service Interruption Guarantee Fund). The money will be credited to the workers’ account with a balance in the fund on December 31, 2022 and can only be used in cases stipulated by law.
The total amount to be distributed depends on the Bank’s profits in 2022, which are estimated at R$15 billion, and on the percentage to be issued by the FGTS Board of Trustees. The council includes representatives from workers, government and businesses.
In 2021, the Council distributed 99% of the result of R$13.3 billion. As a result, the workers received R$13.2 billion. The distribution index was 0.02748761. For every R$100 held in the FGTS account on December 31st, R$2.75 has been credited to the account.
The results of Fundo de Garantia and the discussion about the distribution of profits are presented at a meeting of the Board of Trustees. The commission’s meetings are scheduled for June 20 and July 25. Board representatives heard by Folha claim that the June agenda has nothing to do with FGTS earnings, so the topic could be left for July.
In 2022, the year of the elections, the distribution was defined in July, and the money was restricted a few days after the decision of the council, through the deliberations of the body, which chose to extend the credit to the account of the citizens. However, the money does not easily reach the pocket of the worker, as it can only be withdrawn in cases such as unfair dismissal, retirement and home ownership.
In a note, Caixa stated that “information regarding the FGTS financial statements for fiscal year 2022 will be disclosed on the Caixa and FGTS websites, once it has been resolved by the appropriate governance, including the FGTS Board of Trustees.”
In 2020, the fund had a positive balance of R$8.5 billion. Of this total, Caixa distributed R$8.1 billion, which equals 96% of the profits.
The FGTS revision should not affect the distribution, says the economist
Clovis Scherer, economist at Dieese (Inter-Union Department of Statistics and Socio-Economic Studies) and advisor to the representative of CUT (Central Única dos Trabalhadores) on the Board of Trustees, says he believes the dividend debate will be left for July. .
According to him, the council has not yet met in 2023 and will resume its activities. The economist says that the review of the FGTS, which is under trial in the STF (Supreme Federal Court), should not interfere with the decision to distribute the dividend, but the matter will be discussed by the board, as it may directly affect the fund. budget.
“There is a need to discuss and prepare for the different impact scenarios of the Supreme Court’s decision on the guarantee fund’s budget. Within the board, the question that will arise is: If the current criteria are changed, how to adjust the fund’s budget for the new reality of rewarding linked accounts?
Judgment on the review of the FGTS by the STF began on 20 April. On the 27th, the trial was halted after a request for an opinion was made by Minister Cassio Nunes Marquez. ADI (Direct Action for Unconstitutionality) 5,090, of 2014, questions whether the fund’s monetary restatement formula, which uses TR (reference rate) plus interest at 3% per annum, should be replaced by an index that reflects inflation.
In his vote, Minister Barroso defended that workers’ money in the fund should have at least a savings bonus. Currently, there are two forms of ledger. For deposits made up to May 3, 2012, the update is flat, 0.5% per month plus TR, which equates to 6.17% per annum plus TR. For deposits made after that date, the bonus is linked to the economy’s base interest rate, Selic.
Who is entitled to profit from FGTS?
All FGTS-linked accounts, whether active or inactive, are entitled to the previous year’s earnings. Payment is made by August 31 of each year, for those with a balance on the 12/31 of the base year. Profit is shown separately in each of the worker’s accounts.
How is payment made?
Distribution is carried out by Caixa, which manages the fund. The amounts are credited, and in the FGTS statement the information appears “AC CRED DIST RESULTADO ANO BASE 12 / XXXX (here you will be informed of the year the payment refers to)”.
When are values withdrawn?
The worker will only be able to use this money if he fits one of the withdrawal situations stipulated in Law 8.036 / 90 for FGTS withdrawal, such as dismissal without just cause, retirement, buying a house, serious illness, for example.
How does FGTS work?
The Stopover Compensation Fund was established in 1966 as a provident fund to protect workers in the event of dismissal, illness or retirement. At the time, it was a substitute for the end of the stable of formal professionals.
The fund consists of a monthly deposit of 8% of the worker’s salary. The filing is made by the company to which it is assigned under the CLT (Consolidation of Labor Laws) system.
The law also allows the use of resources for housing, which includes not only real estate financing, but also basic health facilities and urban infrastructure. Caixa still uses the amounts for smaller lending.
There are 16 cases in which money can be withdrawn from the guarantee fund. One of them, the Christmas withdrawal, which was created in 2019, is under discussion by the Lula government. The procedure guarantees the withdrawal of amounts on the occasion of the professional’s birthday, but ends with the withdrawal upon dismissal.
